In the order that you posted the questions...
1. Yes..., though it may vary from airport, country and else.
2. You do have to transmit that you are doing a fly-by (or a go-around maybe?)
3. You can do it anywhere as long as regulations permit, i.e.: Restricted, prohibited, dangerous airspace; also you can't go lower on populated areas than over the sea...just to name one case...
If you are in an emergency...well, emergency is emergency and you have to locate the best area for your emergency landing if you ain't near any airport.
